The Website is owned and operated by VMAX Autotech Private Limited (“Company”), incorporated under the Companies Act, 2013, CIN: U36999HP2021PTC008511.

By accessing or using the Website, creating an account, or purchasing any products or services, you agree to be bound by these Terms and by our Privacy Policy, Returns & Refunds Policy, Warranty Policy, Shipping & Delivery Policy, and any other policies referenced here (collectively, the “Policies”). If you do not agree, please discontinue use of the Website.

1. Definitions
  • “Company”, “we”, “us”, “our”: VMAX Autotech Private Limited.
  • “User”, “you”, “your”: Any person who accesses or uses the Website.
  • “Products”: Automotive performance, modification, enhancement, technology & lifestyle accessories listed on the Website (including, without limitation, throttle-response systems, engine-tuning modules, and related accessories) and any products added from time to time.
  • “Services”: Services offered through the Website, including browsing, creating an account, placing orders, installation bookings where applicable, and customer support.
  • “Order”: A purchase order placed by a User via the Website.
  • “Personal Data”: Information relating to an identified or identifiable individual handled as per law and our Privacy Policy.
2. Eligibility

2.1 You must be 18 years or older and legally competent to contract.
2.2 Products are presently sold and shipped within India only (unless expressly offered otherwise). International orders are not accepted at this time.
2.3 You represent that you are not barred from using the Services under applicable laws.

3. Account Registration & Security

3.1 You may browse without an account; certain features may require registration. Users may sign in using email/password, OTP, or social logins (e.g., Google, Facebook, Apple), subject to availability and our Privacy Policy.
3.2 Provide accurate, current and complete information and keep it updated.
3.3 You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. Notify support@vmaxat.com immediately of suspected unauthorised use.
3.4 We may suspend or terminate accounts at our discretion for suspected fraud, misuse, breach of these Terms, or to comply with law.

4. Ordering, Pricing & Payment

4.1 Product info & compatibility. We strive for accuracy in descriptions, compatibility notes and pricing. Compatibility guidance is indicative; you must confirm suitability for your specific variant before purchase/installation.
4.2 Order acceptance. Your Order is an offer to buy; we may accept or reject (e.g., stock, address, pricing or other errors, suspected fraud, regulatory reasons). Cancelled portions will be refunded.
4.3 Prices & taxes. Prices are in INR; taxes/shipping are shown at checkout. Prices may change prior to Order acceptance.
4.4 Payments. Accepted methods are those displayed at checkout (UPI, cards, net-banking, wallets, etc.). Payments are processed by payment processors; we do not store full card numbers, OTPs, or UPI PINs.
4.5 Fraud checks. We may conduct verification and request information; failure to provide may lead to cancellation.

5. Shipping, Delivery & Risk of Loss

5.1 Dispatch & delivery. Timelines are indicative and may vary by courier/serviceability/external factors. Title and risk pass on delivery to your address.
5.2 Address accuracy. You are responsible for correct, serviceable shipping details. Failed deliveries due to errors may incur delays/charges.
5.3 Inspection. If a package appears tampered/damaged, you may refuse delivery and contact us promptly.

6. Returns, Cancellations & Warranty

6.1 Returns/Exchanges. Governed by our Returns & Refunds Policy. Certain electrical/electronic Products may be non-returnable once opened/installed except for manufacturing defects.
6.2 Cancellations. You may request cancellation before dispatch; post-dispatch cases follow the Returns Policy. We may cancel under Clause 4.2.
6.3 Warranty. Provided per our Warranty Policy and/or the manufacturer’s limited warranty. Proof of purchase and installation records may be required.
6.4 Installation. Must be by qualified technicians per product guidelines. Improper installation, misuse or unauthorised modifications may void warranty.

7. Use of the Website

7.1 Use the Website lawfully. Do not attempt unauthorised access; introduce malware; scrape/harvest content or Personal Data; interfere with other users; or misrepresent affiliation.
7.2 We may modify, suspend or discontinue any part of the Website without liability.

8. Third-Party Services

8.1 The Website may link to or integrate third-party platforms (e.g., payment processors, logistics partners, dealers/distributors, service vendors, mapping/messaging tools). Use is subject to their terms and privacy policies.
8.2 We do not control and are not responsible for third-party content/services/sites. Your interactions are solely between you and the third party.

9. Intellectual Property

9.1 The Website, its content (including text, images, graphics, logos, UI/UX and code), and all related intellectual property rights are owned by VMAX Autotech Private Limited, or, as applicable, its directors or its licensors (including DTE Systems GmbH). All rights reserved.
9.2 Trademarks. MAXOTO™ and other marks on the Website are trademarks/service marks of the Company or its licensors. Third-party marks are the property of their respective owners.
9.3 You receive a limited, revocable, non-exclusive, non-transferable licence to access/use the Website for personal, non-commercial use. You may not copy, modify, distribute, sell, reverse-engineer or create derivative works except as permitted by law.
9.4 Do not remove/alter proprietary notices on the Website or Products.

10. Personal Data & Privacy

10.1 We collect and process Personal Data per applicable laws and our Privacy Policy, following principles of purpose limitation, data minimisation, and security safeguards.
10.2 We never ask for your passwords/OTPs/UPI PINs. Do not share sensitive payment info with anyone.
10.3 Subject to law, you may have rights to access/correct/delete certain Personal Data and to withdraw consent—see Privacy Policy.

11. Compatibility, OEM Warranty & Safety

11.1 Compatibility. Variants differ by model year, engine code, transmission, region equipment. Verify against your exact variant before purchase/installation.
11.2 OEM vehicle warranty. Aftermarket installations may be subject to OEM/dealer policies. Decisions rest with the OEM/dealer; the Company makes no representations regarding OEM warranty coverage.
11.3 Safety. Use Products responsibly and in compliance with traffic laws. Avoid adjustments while driving that could distract or compromise safety.

12. Disclaimers

12.1 The Website and Services are provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement, to the fullest extent permitted by law.
12.2 We do not warrant uninterrupted/error-free operation or freedom from harmful components.
12.3 Third-party content/services are the responsibility of their providers; we do not endorse or assume liability for them.

13. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or use, arising out of or related to your use of (or inability to use) the Website, Products or Services. Our aggregate liability for all claims relating to a particular Order shall not exceed the total amount paid by you for that Order.

14. Indemnity

You agree to indemnify, defend and hold harmless the Company, its directors, officers, employees and agents from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or connected with: (a) your breach of these Terms or law; (b) misuse of the Website or Products; or (c) infringement of third-party rights.

15. Termination & Suspension

We may suspend/terminate your access or account at any time, with or without notice, for any reason including suspected fraud, misuse, breach of these Terms, or to comply with legal requirements. Provisions that should survive (e.g., IP, warranty disclaimers, limitations of liability, indemnities) will survive termination.

16. Force Majeure

We are not liable for delays/failures due to causes beyond reasonable control, including acts of God, natural disasters, epidemics/pandemics, war, terrorism, civil disturbances, labour disputes, government actions, utility/communication outages, or network/hosting failures.

17. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Subject to applicable law, the courts of New Delhi, India shall have exclusive jurisdiction. You submit to the personal jurisdiction of such courts.

18. Changes to Website or Terms

We may update the Website and these Terms from time to time. The “Last Updated” date reflects the latest changes. Continued use after changes constitutes acceptance of the updated Terms. If you do not agree, discontinue use.

20. Miscellaneous

20.1 Entire Agreement. These Terms together with the Policies constitute the entire agreement and supersede prior understandings.
20.2 No Waiver. No waiver is deemed a further or continuing waiver.
20.3 Severability. If any provision is invalid, remaining provisions remain in effect.
20.4 Assignment. You may not assign rights/obligations without our written consent; we may assign to an affiliate or in connection with a merger, acquisition or sale of assets.
20.5 Notices. We may notify you via the Website, email/SMS/WhatsApp to your registered contacts, or courier to your address on file.
